Terms of Service

These Terms of Service (“Terms”) govern your use of the HearthRoll website, web app, and any related software (collectively, the “Service”) operated by HearthPlay Games LLC (“we,” “us,” “our”). By using the Service you agree to these Terms. If you don’t agree, please don’t use the Service.

1. The Service

HearthRoll is an accessible 3D dice roller for tabletop role-playing games. The free version is available to anyone. The premium version unlocks additional themes for a one-time purchase (USD $4.99) processed through Stripe. We may add features, change features, or discontinue features over time.

2. Your account

HearthRoll does not have user accounts in the traditional sense. After buying premium, your access is tied to the email address you provided at checkout. You are responsible for keeping access to that email account — whoever controls the email controls the entitlement.

You may restore your premium access on any device by requesting a magic link to the email tied to your purchase, via the Restore page.

3. License

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for your own personal, non-commercial enjoyment. The premium upgrade does not transfer ownership of any content; it grants access only.

You agree that you will not:

• copy, modify, redistribute, or create derivative works from the Service’s themes, audio, art, or code, except as permitted by an open-source license accompanying that specific component
• reverse engineer, decompile, or disassemble the Service except where required by law
• resell, rent, or share your premium entitlement with others
• attempt to bypass payment, rate limiting, or other security measures
• use the Service to harass, abuse, or harm others
• scrape or otherwise programmatically extract data from the Service

4. Payments and refunds

All purchases are processed by Stripe. Prices are shown in the currency listed on the pricing page and may be subject to local taxes. The premium upgrade is a single one-time purchase — there is no subscription, no recurring charge, and no auto-renewal.

Refund policy: Refunds are available within 14 days of purchase, no questions asked. To request a refund, email privacy@hearthroll.app from the email address you used at checkout. Refunds are processed back to your original payment method via Stripe. Some jurisdictions (notably the European Union) grant statutory rights of withdrawal that override anything we say here; nothing in these Terms is intended to limit those rights.

If you initiate a chargeback or payment dispute, your premium access will be revoked immediately and may not be restored even if the dispute is later resolved in our favor. If you believe a charge is in error, please email us first — we’d much rather refund you directly than fight a dispute.

5. Service availability

We provide the Service “as is” and “as available.” We do not promise any specific uptime or that the Service will be free of bugs, errors, interruptions, or security vulnerabilities. We may take the Service offline for maintenance, upgrades, or for any other reason, with or without notice. We are a small indie team, not an enterprise vendor.

6. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, attempt to defraud us, or use the Service in a way that harms other users. If we permanently terminate your access for a violation, you will not be entitled to a refund.

We may also discontinue the Service entirely. If we do, we will give you reasonable advance notice via the email tied to your entitlement and, if practical, offer a pro-rated refund or an export of your premium content.

7. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

8. Limitation of liability

To the maximum extent permitted by law, in no event will HearthPlay Games LLC, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of (or inability to use) the Service. Our aggregate liability under these Terms will not exceed the amount you paid us in the twelve months preceding the claim, or USD $4.99, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply only to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless HearthPlay Games LLC from any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of your breach of these Terms or your misuse of the Service.

10. Governing law

These Terms are governed by the laws of Commonwealth of Virginia, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the courts located in Commonwealth of Virginia, United States, and you consent to the personal jurisdiction of those courts.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. For material changes that affect existing premium customers, we will also notify you by email. Your continued use of the Service after the changes take effect constitutes your acceptance of the new Terms.
